1. Application of the general terms and conditions of sale
The general terms and conditions of sale described below (hereinafter referred to as "General Conditions") govern the contractual relationships between users of the website www.giannonebakery.it (hereinafter referred to as "Customers") and the company Giannone Bakery di Carmelo Giannone, via Trapani Rocciola 15a, 97015 Modica (Rg), VAT No.: 01743770883, Tel. 3398883549, info@giannonebakery.it and registered with the Chamber of Commerce of Ragusa. These general conditions are the only ones applicable and may be modified without prior notice and will be valid from the date of publication on the website www.giannonebakery.it. The validation of an order implies the tacit reading and acceptance of the general conditions present at that time on the site. Giannone Bakery reserves the right to refuse any type of clause and/or document attached to the customer's order that is in opposition to and/or adds a new element to the general conditions.

3. How to order
The product catalog is organized according to different product categories.
The Customer can access the product page through the internal search engine and the links to categories and individual products on the site. Once the product has been identified, it can be added to the cart by specifying the desired quantity. In the cart, it is possible to modify quantities, remove items already present, and proceed to fill out the order form by clicking the Next button. Both private customers and companies can make purchases.
Each order is a contract entered into between Giannone Bakery and the Customer.
Each order shall be considered concluded upon acceptance, even partial, by Giannone Bakery, which reserves the right to accept the order itself.
Acceptance is always explicit and is communicated to the Customer at the email address provided at the time of the order. This confirmation message will include the Date and Time of the order and a "Customer Order Number" to be used in any further communication with Giannone Bakery. By placing an order, the Customer must declare that they have read all the information provided during the purchase process and fully accept the general and payment conditions.
In the event of non-acceptance of the order, Giannone Bakery undertakes to promptly inform the Customer.
4. Order form
In the order form, it is necessary to enter the details of the purchaser and the recipient (if different) and of the goods to be ordered. Delivery to P.O. Boxes and Poste Restante is not permitted.
After filling in the data, the order summary will be displayed, showing the goods being purchased, partial and total amounts, applied VAT rates, and shipping costs.
If the data is correct, you can proceed with the payment by choosing between Credit Card, PayPal, Apple Pay, Google Pay, Satispay, or bank transfer.
5. Order cancellation
It is possible to cancel orders that have not yet been processed by writing to the email info@giannonebakery.it. If payment was made by Credit Card or PayPal, following the cancellation of the order (by the customer or by Giannone Bakery), Giannone Bakery will request the cancellation of the transaction and the refund of the amount paid.
6. Prices, VAT and currency
The indicated prices include VAT. Fiscal documentation for companies and private customers. The goods are always accompanied by the invoice. In addition, Giannone Bakery will send a copy of the fiscal invoice by e-mail in PDF electronic format at the time the order is processed.
7. Methods and delivery times
Giannone Bakery will ship the ordered products via its trusted courier within 5 working days from receipt of payment. Any specific delivery requirements can be specified by the Customer directly in the notes field before completing the order. If Giannone Bakery is unable to ship within this period, prompt notice will be given to the Customer via email, indicating the timeframe within which the order will be fulfilled. Once the goods have been taken over by the courier, the latter will send communications directly to the customer's email account; therefore, Giannone Bakery recommends checking the email associated with the order and monitoring the shipment status. If the first delivery attempt is unsuccessful, the courier will place the goods in storage. Giannone Bakery will not be responsible for any delivery delays due to unforeseen events and force majeure. Delivery costs are calculated at the time of order based on the destination, the chosen payment method, and the type of item purchased. Upon delivery, the Customer is required to check that the packaging is intact and that the number of packages matches that indicated on the delivery document. In case of damage or anomalies to the packaging, the Customer is requested to accept the delivery "with reservation" and have this noted on the delivery document, along with the reason for the reservation. This is essential to allow Giannone Bakery to subsequently file a claim with the courier for damages and transport anomalies. In these two cases, the costs of replacement and redelivery will be entirely borne by Giannone Bakery. Giannone Bakery declines all responsibility for the acceptance of an anomalous package not checked at the time of delivery in the presence of the carrier.
8. Payment methods
Giannone Bakery accepts payment for ordered products via major Credit Cards (Mastercard, Visa, American Express), Satispay, Apple Pay, and Google Pay. A link to NEXI will be sent for card payment, or a link to Satispay if chosen. The information is encrypted using state-of-the-art encryption systems that prevent third-party use and is sent directly to the bank.
Giannone Bakery reserves the right to request the issuing bank of the card to verify the authenticity of the cardholder in case of issues. For any possible refund to the Buyer, if they are entitled to it,
Giannone Bakery will refund you within 14 (fourteen) days from the verification of conformity, any amounts already collected for the purchase of the products, by bank transfer, according to the methods and terms provided. In compliance with Anti-Money Laundering Regulations, the beneficiary of such bank transfer cannot be a natural person other than the holder of the credit card originally used for payment for the purchase of the products. If this requirement is not met, following subsequent verification and any reports of violations, the Seller will take legal action against the buyer in accordance with current regulations.
9. Security in transactions
Online payments are made either at the same time as the completion of the order transaction or deferred until the order is accepted, and in a protected and secure manner, ensuring absolute privacy in the transmission of credit card information, which therefore cannot be viewed by other users on the network. The entry and submission of credit card information takes place with maximum security thanks to the secure servers of our payment partner. The servers that carry out the transactions and protect customers' personal data use the international 128-bit SSL security protocol. SSL encrypts the customer's credit card data, preventing anyone from decoding it.
10. Warranty
Giannone Bakery reserves the right to modify product property information without any prior notice. The image accompanying the product description sheet may not perfectly represent its characteristics, and may differ in color, size, or accessory products shown in the picture. Giannone Bakery assumes no responsibility for any errors present in the product sheets of the marketed items, which should therefore be considered as purely for commercial and marketing display purposes. The essential characteristics of the products are presented within each product sheet.
If the product is found to be altered in its essential characteristics or not edible (in the case of a food product), Giannone Bakery undertakes to replace the altered goods with a new supply at its own expense.
11. Right of withdrawal
In case of:
- damage to the packaging
- product malfunction
The customer must, within no more than 24 hours from receipt of the goods, send a communication to the email address info@giannonebakery.it indicating the order number and date of reference and the issues encountered, attaching some photographs of the products as evidence. The request will be handled by our customer care office and if we find that the product is not suitable or the packaging has been damaged by the courier, we will proceed with a refund or, if necessary, with the redelivery of the product.
12. Disputes
The sales contract between the Customer and Giannone Bakery is considered concluded in Italy and governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference in their municipality of residence; in all other cases, the exclusive territorial jurisdiction is that of the Court of Ragusa.
13. Privacy protection
Giannone Bakery guarantees that the processing of data, which may be received via email or electronic forms, complies with privacy regulations.
Anything that is sent to our email addresses (orders, requests, suggestions, ideas, information, etc.) will not be considered confidential information or data.
Giannone Bakery customers can freely access information, product sheet details, informational texts, and all those services that do not require the entry of personal data to be used.
The data relating to the credit or prepaid cardholder or bank account entered after order confirmation are sent and processed exclusively by NEXI for the following purposes: completion and support of access; execution of the transaction the user is carrying out; fulfillment of legal obligations; operational and management needs.
Privacy notice
Giannone Bakery intends to carry out certain activities involving the processing of the Customer's personal data sent via email or electronic forms (Personal Account sections related to the proposed items). These activities are necessary to fulfill the Customer's requests, suggestions, and for all commercial, fiscal, administrative, and informational purposes related to the activities of Giannone Bakery. To this end, pursuant to and for the purposes of Legislative Decree No. 196 of June 2003 (Personal Data Protection Code), Giannone Bakery provides the following information regarding the processing we intend to carry out.
Processing methods
The processing will be carried out through the collection, processing, and comparison of data and through the use of computer or telematic tools for which appropriate security measures are employed to ensure confidentiality as well as to prevent unauthorized access by third parties or unauthorized persons. The activities will be carried out through automated and computerized procedures, exclusively at the data processing systems of Giannone Bakery or other parties bound by contractual relationships (banks, insurance companies, express couriers, ISPs). The data controller is the legal representative of Giannone Bakery.
Communication of personal data relating to the order. The personal data entered will be used exclusively for order management, shipping of goods, and invoicing. Under no circumstances will they be disclosed to third parties or used for sending commercial communications and advertising material.
Communication of data relating to community registration. The data entered at the time of registration to the Personal Account may be processed for internal statistical evaluations in order to improve the quality of the commercial service. Under no circumstances will they be transferred to third parties or used for sending commercial or promotional communications unless the Customer's consent is given.

14. Unfair terms
Art. 1341
General terms and conditions of contract.
[I] The general contract conditions prepared by one of the parties are effective towards the other, if at the time of the conclusion of the contract the latter knew them or should have known them by exercising ordinary diligence.
[II] In any case, the conditions that establish, in favor of the party who prepared them, limitations of liability, the right to withdraw from the contract or to suspend its execution, or that impose on the other party forfeitures, limitations on the right to raise objections, restrictions on contractual freedom in relations with third parties, tacit extension or renewal of the contract, arbitration clauses or derogations from the jurisdiction of the judicial authority, have no effect unless they are specifically approved in writing.
